Welcome to IHP – Shop! The terms “we,” “us,” and “our” refer to IHP – Shop. IHP – Shop operates this store and website, including all information, content, features, tools, products, and services, in order to provide you, the customer, with an appropriate shopping experience (the “Services”). IHP – Shop is supported by Shopify, which enables us to provide you with the Services.
The terms and conditions below, together with any policies referenced herein (“Terms of Service” or “Terms”), describe your rights and responsibilities when using the Services.

When you place an order, you are submitting an offer to purchase. IHP – Shop reserves the right to accept or reject your order at our discretion for any reason. Your order is not confirmed until IHP – Shop has accepted it. Before accepting an order, we must receive and process payment. Please review your order carefully before submitting it, as IHP – Shop may not be able to accommodate cancellation requests once an order is accepted. In the event of order refusal, modification, or cancellation, we will notify you using the email address, billing address, and/or phone number you provided at checkout.
Your purchases are eligible for returns or exchanges only in accordance with our Refund Policy.
You represent and warrant that you are making purchases for personal or household use only, not for resale or export.

Prices, discounts, and offers are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is submitted and will appear on your order confirmation email. SECTION 5 – SHIPPING AND DELIVERY
We are not responsible for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not liable for delays due to shipping carriers, customs procedures, or events beyond our control. Once products have been transferred to the carrier, ownership and the risk of loss pass to you.
SECTION 6 – INTELLECTUAL PROPERTY
Our Services—including but not limited to trademarks, branding, text, visuals, images, graphics, product reviews, video and audio content, as well as the design, selection, and arrangement thereof—are owned by IHP – Shop, its affiliates, or licensors and are protected by U.S. and international laws governing patents, copyright, and intellectual property.

All other trademarks displayed in the Services belong to their respective owners.

IHP – Shop is powered by Shopify, which enables us to provide the Services. However, sales and purchases you make in our store occur directly between you and IHP – Shop. By using the Services, you understand and agree that Shopify is not responsible for any aspect of the transactions between you and IHP – Shop, including any injuries, damages, or losses arising from your purchase of products or services. You expressly release Shopify and its affiliates from any claims, damages, or liabilities arising from or related to transactions made with IHP – Shop.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IHP – SHOP, OR OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, MERCHANTS, SERVICE PROVIDERS, OR LICENSORS—OR SHOPIFY AND ITS AFFILIATES—BE LIABLE FOR ANY INJURIES, LOSSES, CLAIMS, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PROCURED THROUGH THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR PRODUCTS, INCLUDING BUT NOT LIMITED TO ERRORS OR OMISSIONS IN ANY CONTENT OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR CONTENT (OR PRODUCTS) POSTED, TRANSMITTED, OR MADE AVAILABLE THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless IHP – Shop, Shopify, and our affiliates, partners, officers, directors, employees, agents, merchants, licensors, and service providers from any losses, damages, liabilities, or claims—including reasonable legal fees—arising from:
(1) your breach of these Terms or any documents they reference,
(2) your violation of any law or third-party rights, or
(3) your access to or use of the Services.
We will notify you of any indemnifiable claim, provided that failure to provide prompt notice does not release you from your obligations unless you are materially prejudiced. We may control the defense and settlement of such claims at your expense, including choosing counsel, but we will not settle claims requiring non-monetary obligations from you without your consent (which cannot be unreasonably withheld). You will cooperate in the defense of any non-indemnified claims, including providing relevant documents.
SECTION 18 – SEVERABILITY
If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed from these Terms without affecting the validity or enforceability of the remaining provisions.

Failure by Shopify to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
These Terms of Service and any policies or operating rules posted by us on the site or relating to the Services constitute the entire agreement and understanding between you and us, governing your use of the Services and superseding any prior or contemporaneous agreements, communications, or proposals, whether oral or written (including earlier versions of the Terms).
Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.
SECTION 20 – ASSIGNMENT
You may not delegate, transfer, or assign these Terms or any of your rights or obligations without our written consent; any attempted assignment will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without notice or your consent.
SECTION 21 – GOVERNING LAW
These Terms of Service and any separate agreements under which we provide the Services shall be governed and construed in accordance with the federal, state, or territorial courts of the jurisdiction in which IHP – Shop is headquartered. You and IHP – Shop agree to personal jurisdiction in those courts.
